Funtech OÜ Rental Terms and Conditions
By renting property belonging to Funtech OÜ, the Renter accepts these rental terms. All disputes shall be resolved based on these terms and the laws of the Republic of Estonia.
The basis for renting property is a rental offer or calculation provided by Funtech OÜ or generated via the website www.tourguide.ee, which specifies the exact list of rented items, the length of the rental period, and the total cost.
The Renter is obligated to return the property no later than 13:00 (1:00 PM) on the day following the end of the rental period specified in the offer. Property may be returned at other times only by prior agreement between the parties.
In the event that the Renter returns the property later than the aforementioned deadline, the Renter is obligated to pay for the days exceeding the deadline.
The Renter is obligated to:
7.1 Use the property prudently and for its intended purpose, and not leave the property unattended;
7.2 Return the property cleaned and in working order; otherwise, the Renter must reimburse Funtech OÜ for the costs of cleaning, restoring, and configuring the property;
7.3 Immediately notify a representative of Funtech OÜ if the rented property proves to be malfunctioning. If the fault reported by the Renter proves to be unfounded, the Renter is still obligated to pay the rental fee based on the rental offer;
7.4 Immediately notify the lessor if the property is lost, damaged, or destroyed;
7.5 In the event of loss or destruction of the property, the Renter is obligated to reimburse Funtech OÜ for the market value of said property;
7.6 In the event of damage to the property, the Renter is obligated to reimburse Funtech OÜ for the repair costs.
The Renter does not have the right to:
8.1 Independently perform or commission repair work on Funtech OÜ’s property from third parties.
Funtech OÜ has the right to:
9.1 Reclaim property from any unlawful possession;
9.2 Demand early termination of the contract if it appears that the Renter has knowingly provided false information regarding the circumstances of the rental.
Funtech OÜ has the obligation to:
10.1 Immediately notify the Renter if, after the return of the property, it is determined that the rented property has become unusable or its value has significantly decreased;
10.2 Waive rental fee claims (either partially or fully) in favor of the Renter if it appears that the property issued to the Renter was (either partially or fully) unusable.
